Terms of Service

Last updated: 10/25/2026

1. Acceptance

By accessing or using the Platform, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Platform.

2. Educational purpose; no medical advice

The Platform provides general educational information about preventive cardiology and lipid management, including protocol summaries related to statin intolerance. The Platform does not provide medical advice, diagnosis, or treatment. Any information reviewed by a clinician engaged through the Platform is intended as educational suggestion only and does not create a physician-patient relationship unless expressly established in writing under applicable state law. Always seek the advice of your own qualified health provider with any questions you may have about a medical condition.

3. Eligibility and jurisdiction

You represent that you are at least 18 years old. Public education is available worldwide. Certain paid or clinician-linked features may not be available in every country, state, or region. See our State Availability and International pages for current information.

4. Educational use and health information

The educational Platform is not designed to receive health information, and you agree not to submit diagnoses, medicines, results, records, or health narratives through it. Educational content is available worldwide; this does not mean any clinician is licensed where you are. Clinical services, where separately offered, depend on clinician licensure and your physical location at the time of care and use a separate workflow.

5. Payments

Fees for services are displayed on the Platform prior to purchase. Payments are processed by a third-party payment processor. Individuals who have executed a written Independent Contractor Agreement with My Heart Spark, PC and who are in good standing are exempt from Platform fees for services covered by that agreement.

6. Acceptable use

You will not misuse the Platform, attempt to access it by any means other than the interface provided, interfere with its operation, submit false information, or use the Platform to violate any law.

7. Intellectual property; assignment of feedback and submissions

The Platform, its content, and all associated trademarks and service marks are owned by My Heart Spark, PC or its licensors. You are granted a limited, revocable, non-exclusive, non-transferable license to access the Platform for personal, non-commercial use.

You agree that any feedback, suggestions, ideas, feature requests, workflows, protocols, prompts, worksheets, tools, screenshots, mockups, code snippets, or other materials you submit through the Platform (collectively, “Submissions”) are non-confidential and are hereby irrevocably assigned to My Heart Spark, PC, together with all associated worldwide intellectual property rights, including copyrights, patent rights, trade secret rights, and moral rights, in perpetuity and without compensation. You waive any moral rights and agree that My Heart Spark, PC may use, reproduce, modify, publish, distribute, and commercialize Submissions for any purpose without attribution. If any Submission cannot be assigned as a matter of law, you grant My Heart Spark, PC a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable license to use it for any purpose.

7A. Consolidated consent

By using the Platform, creating an account, submitting an intake, downloading a resource, or clicking “Accept & Agree” on the cookie banner, you acknowledge and agree to these Terms, the Privacy Policy, the Cookies Policy, the Medical Disclaimer, and the educational-only nature of the Platform, as a single, integrated agreement.

7B. HSA / FSA and CME funds

Educational health-and-wellness services and clinician professional-development resources offered on the Platform may, at the sole discretion of your plan administrator or employer, be eligible for reimbursement through a Health Savings Account (HSA), Flexible Spending Account (FSA), or Continuing Medical Education (CME) fund. My Heart Spark, PC does not represent, warrant, or guarantee eligibility for any specific plan, and does not provide tax or benefits advice. You are solely responsible for confirming eligibility with your plan administrator and for retaining documentation.

7C. CSPN Working Group access

Individuals who have executed a written CSPN Working Group Agreement with My Heart Spark, PC (formerly referred to as the Independent Contractor Agreement) and who are in good standing may be issued a CSPN Working Group access code granting complimentary access to Platform services covered by that agreement. Access codes are personal, non-transferable, and may be revoked at any time.

8. Disclaimers

The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, My Heart Spark, PC and its officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, arising out of or related to your use of the Platform.

10. Dispute resolution; good-faith discussion, then mediation, then arbitration

The parties will first attempt in good faith to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Platform through direct, confidential good-faith discussion between designated representatives of each party for a period of at least thirty days from written notice of the dispute. If good-faith discussion does not resolve the dispute, the parties will submit the dispute to non-binding mediation administered by a mutually agreed neutral mediator, with each party bearing its own costs and the parties sharing the mediator’s fees equally. If mediation does not resolve the dispute within sixty days of the mediator’s appointment, the dispute shall be finally resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with a single arbitrator, seated in the state of My Heart Spark, PC’s principal place of business, and conducted in English. The parties expressly waive any right to a trial by court or jury and waive any right to participate in a class, collective, or representative action. Judgment on the arbitration award may be entered in any court of competent jurisdiction. Nothing in this section prevents either party from seeking equitable relief to protect intellectual property rights.

11. Governing law

These Terms are governed by the laws of the state of My Heart Spark, PC’s principal place of business, without regard to its conflict-of-laws principles.

12. Changes

We may update these Terms from time to time. Material changes will be posted here with a new “Last updated” date. Continued use of the Platform after changes constitutes acceptance.

13. Contact

Questions about these Terms may be sent to connect@myheartspark.com.
